As the New York Times noted on Saturday, the Obama Administration has backtracked on several of the most important civil liberties issues that candidate Obama criticized — most importantly, state secrets and military commissions. (h/t Greenwald).

Meanwhile, OLC nominee Dawn Johnsen’s nomination has been left in limbo in the Senate, with no one really sure what is next. And the Administration has been silent about it.

Whether one can conclude that the President has hung his nominee out to dry is an exercise left to the reader.
