The Principal Deputy Solicitor General of the United States assured the Supreme Court that even non-citizens held as “unlawful combatants” would not be subjected to torture, eight hours before the Abu Ghraib photos were shown on CBS News.

No doubt Mr. Clement thought he was telling the truth. But if I were one of the Justices, I think I might be a little bit peeved.

At least this make sense of Gen. Myers’s request to CBS News to postpone showing the photos.
